TERMS AND CONDITIONS

BY SUBMITTING ORDERS YOU AGREE TO THESE TERMS & CONDITIONS of this website and the laws and rules that fall under the jurisdiction of the state of Arizona.

IF YOU DO NOT AGREE, PLEASE DO NOT USE THE SITE.

Cori Anthony Clothing Co. reserves the right, at its sole discretion, to change, add or remove portions of these Terms & Conditions, at any time. It is your responsibility to check the Terms & Conditions each time before using the Site. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes. You agree that all subsequent purchases by you will be subject to the Terms & Conditions, which shall apply until we post a modified Terms & Conditions and then in accordance with such modified Terms & Conditions. As long as you comply with these Terms & Conditions and any such modifications, Cori Anthony Clothing Co. grants you ("End User") a personal, non-exclusive, non-transferable, non-sub licensable, limited privilege to enter and use the Site. Furthermore, you will be held responsible for all attorney's fees, chargeback fees and court costs in the event that Cori Anthony Clothing Co. must enforce this agreement or a chargeback is initiated by the cardholder and payment is found to be cardholders responsibility.


1. Content; Copyright and Trademark Notice
All media (downloaded or samples), software, text, images, graphics, user interfaces, music, videos, photographs, trademarks, logos, artwork and other content on the Site (collectively, "Content"), including but not limited to the design, selection, arrangement, and coordination of such Content on the Site is owned or licensed by or to Cori Anthony Clothing Co., and is protected by copyright, trade dress, and trademark laws, and various other intellectual property rights laws. Except as expressly provided in this Terms & Conditions, no part of the Site and no Content may be reproduced, recorded, retransmitted, sold, rented, broadcast, distributed, published, uploaded, posted, publicly displayed, altered to make new works, performed, digitized, compiled, translated or transmitted in any way to any other computer, website or other medium or for any commercial purpose, without Cori Anthony Clothing Co.'s prior express written consent. Except as expressly provided herein, you are not granted any rights or license to patents, copyrights, trade secrets, trade dress, rights of publicity or trademarks with respect to any of the Content, and Cori Anthony Clothing Co. reserves all rights not expressly granted hereunder. Cori Anthony Clothing Co. expressly disclaims all responsibility and liability for uses by you of any Content obtained on or in connection with the Site.

2. Use of Site
You agree to provide us with accurate, current and complete information about yourself and your billing information as prompted by the purchasing process. You may not use any automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy, probe, test or monitor any portion of the Site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or any of the systems or networks comprising or connected to the Site.

You also agree that Cori Anthony Clothing Co. may, in its sole discretion and without prior notice to you, terminate your access to the Site and your Account for any reason, including without limitation: (1) attempts to gain unauthorized access to the Site or assistance to others' attempting to do so, (2) overcoming software security features limiting use of or protecting any Content, (3) discontinuance or material modification of the Site or any service offered on or through the Site, (4) violations of this Terms & Conditions, (5) failure to pay for purchases, (6) suspected or actual copyright infringement, (7) unexpected operational difficulties, or (8) requests by law enforcement or other government agencies. You agree that Cori Anthony Clothing Co. will not be liable to you or to any third party for termination of your access to the Site.

Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including a Cori Anthony Clothing Co. or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.

3. Consent to Collection, Use & Disclosure of Your Personal Information
As more fully described in our Privacy Policy, you must disclose certain Personally Identifiable Information to use our Site, and make purchases. As a condition of making any purchases of any products and/or services or conduct any transactions, you represent that you have first read our Privacy Policy and consent to the collection, use and disclosure of your Personally Identifiable Information and Non-Personally Identifiable Information as described in our Privacy Policy. Our Privacy Policy's terms and conditions will change from time to time, and as a condition of browsing the Site, using any features or making any purchase, you agree that you will first review our Privacy Policy prior to making any initial or subsequent purchases.

While Cori Anthony Clothing Co. takes reasonable steps to safeguard and to prevent unauthorized access to your personal information, we cannot be responsible for the acts of those who gain unauthorized access, and we make no warranty, express, implied, or otherwise, that we will prevent unauthorized access to your private information. IN NO EVENT SHALL CORI ANTHONY CLOTHING CO. LTD BE LIABLE FOR ANY DAMAGES (WHETHER CONSEQUENTIAL, DIRECT, INCIDENTAL, INDIRECT, PUNITIVE, SPECIAL OR OTHERWISE) ARISING OUT OF, OR IN ANY WAY CONNECTED WITH, A THIRD PARTY'S UNAUTHORIZED ACCESS TO YOUR PERSONAL INFORMATION, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, STRICT LIABILITY, TORT OR OTHER THEORIES OF LIABILITY, AND ALSO REGARDLESS OF WHETHER CORI ANTHONY CLOTHING CO. WAS GIVEN ACTUAL OR CONSTRUCTIVE NOTICE THAT DAMAGES WERE POSSIBLE.

4. Consent to Our Communication with You by E-Mail   
Each time you make a purchase through our Site, you grant permission for Cori Anthony Clothing Co. to contact you and deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Cori Anthony Clothing Co.. 

5. Term; Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Cori Anthony Clothing Co. without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

6. Conditions of Sale and Payment Terms
To purchase any goods and/or services on our Site, you must (a) be at least sixteen (16) years of age, (b) be a natural person (no corporations, partnerships or other legal entities). Prior to the purchase of any goods or services on our Site, you must provide us with a valid payment method either cash, check, PayPal or valid credit card number and associated payment information including all of the following: (i) your name as it appears on the card, (ii) your credit card number, (iii) the credit card type, (iv) the date of expiration and (v) any activation numbers or codes needed to charge your card. By submitting that information to us, you hereby agree that you authorize us to charge your card at our convenience but within thirty (30) days of credit card authorization. All sales of products and services are final. All charges from those sales are nonrefundable.

7. Methods of Payment, Credit Card Terms and Taxes
All payments must be made before the goods are actually sent, either by cash, cheque, PayPal or a valid Credit/Debit card. Your card issuer agreement governs your use of your designated card, and you must refer to that agreement and not these Terms & Conditions to determine your rights and liabilities as a cardholder. YOU, AND NOT CORI ANTHONY CLOTHING CO. LTD, ARE RESPONSIBLE FOR PAYING ANY UNAUTHORIZED AMOUNTS BILLED TO YOUR CREDIT CARD BY A THIRD PARTY. You agree to pay all fees and charges incurred in connection with your purchases (including any applicable taxes) at the rates in effect when the charges were incurred. Unless you notify Cori Anthony Clothing Co. of any discrepancies within sixty (60) days after they first appear on your credit card statement, you agree that they will be deemed accepted by you for all purposes. If Cori Anthony Clothing Co. does not receive payment from your credit card issuer or its agent, you agree to pay all amounts due upon demand by Cori Anthony Clothing Co. or its agents. You are responsible for paying any governmental taxes imposed on your purchases, including, but not limited to, sales, use or value-added taxes.

8. Order Acceptance Policy
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Cori Anthony Clothing Co. reserves the right at any time after receipt of your order to accept or decline your order for any reason. Cori Anthony Clothing Co. further reserves the right any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. Your order will be deemed accepted by Cori Anthony Clothing Co. upon our delivery of products or services that you have ordered. We may require additional verifications or information before accepting any order. Cori Anthony Clothing Co. is a reseller to end users and does not accept orders from resellers, exporters, wholesalers, any businesses of any kind or other customers who intend to resell.

9. No Responsibility To Sell Mispriced Products Or Services
Cori Anthony Clothing Co. shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, rebate or refund, or containing any other incorrect information or typographical errors. Cori Anthony Clothing Co. shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Cori Anthony Clothing Co. shall immediately issue a credit to your credit card account in the amount of the charge.

10. Modifications to Prices or Billing Terms
CORI ANTHONY CLOTHING CO. RESERVES THE RIGHT, AT ANY TIME, TO CHANGE ITS PRICES AND BILLING METHODS FOR PRODUCTS OR SERVICES SOLD, EFFECTIVE IMMEDIATELY UPON POSTING ON THE SITE OR BY E-MAIL DELIVERY TO YOU.

11. Indemnification
You agree to indemnify and hold harmless Cori Anthony Clothing Co. and its parents, sister companies, subsidiaries, affiliates, service providers, other End Users, distributors, licensors, officers, directors and employees from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of or related to your violation of this Terms & Conditions, or your violation of any law, regulation or third-party right.

12. Disclaimer of Warranties
THE SITE, PRODUCTS, SERVICES, CONTENT, DIGITAL DOWNLOADS, SOFTWARE, ARTWORK, DATA, AND INFORMATION ARE PROVIDED "AS IS” and "AS AVILABLE" basis and are subject to change at any time without notice to you.

13. Third-Party Links
In an attempt to provide increased value to our visitors, Cori Anthony Clothing Co. may link to sites operated by third parties. However, even if the third party is affiliated with Cori Anthony Clothing Co., Cori Anthony Clothing Co. has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Cori Anthony Clothing Co.. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Cori Anthony Clothing Co. seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).

We welcome your comments and feedback regarding our Site, our products and our services. We do not, however, accept confidential or proprietary information. Accordingly, all comments, feedback, ideas, suggestions, materials, information and other submissions disclosed, submitted or offered to Cori Anthony Clothing Co. using this Site or otherwise collectively, are not confidential and will be come and remain Cori Anthony Clothing Co.'s® property. The disclosure, submission or offer of any Comments will constitute an assignment to Cori Anthony Clothing Co. of all worldwide rights, titles and interest and goodwill in the Comments without payment of any compensation. Comments submitted by you must not violate any right of any third part, and must not contain any libelous, abusive, obscene or otherwise unlawful material.

15. Miscellaneous
Your use of this site shall be governed in all respects by the laws of the state of California, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Cori Anthony Clothing Co. products) shall be in the state or federal courts located in Los Angeles County, California. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Cori Anthony Clothing Co. products) must be commenced within one (1) year after the claim or cause of action arises. Cori Anthony Clothing Co.'s failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Cori Anthony Clothing Co. may assign its rights and duties under this Agreement to any party at any time without notice to you.

16. LIMITATION OF LIABILITY
THE ENTIRE RISK ARISING OUT OF THE USE OF THE SITE, THE USE OF ANY PRODUCTS AND/OR SERVICES OFFERED ON OR IN CONNECTION WITH THE SITE, AND/OR THE USE OF ANY CONTENT AND/OR DIGITAL DOWNLOADS REMAINS WITH YOU. IN NO EVENT SHALL CORI ANTHONY CLOTHING CO. OR ITS LICENSORS OR ANY OF THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR AFFILIATES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT, SPECIAL, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF THESE TERMS & CONDITIONS OR THE USE OF OR INABILITY TO USE ANY PRODUCTS, SERVICES, CONTENT AND/OR DIGITAL DOWNLOADS, WITH THE DELAY OR INABILITY TO USE THE CORI ANTHONY CLOTHING CO. SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE PRODUCTS OR SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND CONTENT OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE CORI ANTHONY CLOTHING CO. SITE WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE EVEN IF CORI ANTHONY CLOTHING CO. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING ELSE IN THESE TERMS & CONDITIONS OR POSTED ON THE SITE, THE MAXIMUM LIABILITY THAT CORI ANTHONY CLOTHING CO. SHALL HAVE IS LIMITED TO ANY AMOUNTS ACTUALLY PAID TO CORI ANTHONY CLOTHING CO. BY END USER. YOU ASSUME ALL RISK OF LOSS FOR SHIPPED PRODUCTS. ORDER INFORMATION SUCH AS BILLING OR SHIPPING ADDRESS THAT IS INACCURATE OR INCOMPLETE MAY RESULT IN DELAYS THAT SHALL NOT BE THE RESPONSIBILITY OF CORI ANTHONY CLOTHING CO.. YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS OF LIABILITY, DISCLAIMERS OF WARRANTIES AND LIMITED REMEDIES SET FORTH HEREIN REPRESENT AN INSEPARABLE ALLOCATION OF RISK (INCLUDING, WITHOUT LIMITATION, IN THE EVENT OF A TOTAL AND FUNDAMENTAL BREACH OF THESETERMS & CONDITIONS) THAT IS AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN THE PARTIES.

17. General
No delay or failure to take action under these Terms & Conditions shall constitute any waiver by Cori Anthony Clothing Co. of any provision of these Terms & Conditions. If any provision of these Terms & Conditions is invalid or unenforceable under applicable law, it is, to that extent, deemed enforceable to the fullest extent possible (and severable in the event such provision is completely unenforceable) and the remaining provisions of these Terms & Conditions will continue in full force and effect. These Terms & Conditions will bind and inure to the benefit of Cori Anthony Clothing Co.'s permitted successors and assigns. Any claim under these Terms & Conditions must be brought within one (1) year after the cause of action arises. These Terms & Conditions are personal to you and may not be transferred, assigned or delegated to anyone. Any attempt by you to assign, transfer or delegate these Terms & Conditions shall be null and void. Cori Anthony Clothing Co. may freely assign these Terms & Conditions without consent or notice. These Terms & Conditions (including all documents expressly incorporated herein by reference, including but not limited, to the relevant Usage Rules) constitutes the complete and exclusive agreement between Cori Anthony Clothing Co. and you with respect to the subject matter hereof and supersedes all prior oral or written understandings, communications or agreements not specifically incorporated herein.



  RETURN POLICY

What is your return policy?

• Only items that have been purchased from this website can be returned according to the following policy.

• Every garment is satisfaction guaranteed or you may return it for a return of the item price, excluding shipping and handling.


Wrong Product Shipped - We must be contacted within 14 days of package delivery:

Merchandise may only be returned if we have made a mistake of sending you the wrong order/item or if you received a damaged item. On those returns, original shipping cost will not be reimbursed, however there will be no charge for shipment of the item(s) re-sent.

If the mistake is ours we do everything needed to make sure you receive the correct product in a timely fashion.  We do need to receive the original order back before replacement can be made.  If we are not contacted within 14 days of package delivery, you will be charged for the return shipping cost.

If we are contacted within 14 days of package delivery, there will be no charge for the return shipping cost.

 
All other returns

• All returns to Cori Anthony Clothing Co. must be returned within 30 days of invoice date.

• Customers will be responsible for all returning shipping cost unless the garment(s) received was the wrong order/item or a damaged item.

• Any returns received after 30 days of invoice will not be refunded or exchanged.

• All returns must be in saleable condition, (unworn) and must include its original plastic packaging with tags attached to the garment.

• Clearance and sale merchandise are FINAL sales. NO RETURNS.

• A $25.00 cancellation fee will apply on orders that have been submitted for payment and cancelled.  This is to cover the fees we experience from the credit card companies when originally taking a payment and other expenses incurred to start your order process. 

• Returns take approximately 2-4 weeks for processing. We appreciate your patience.

• All return, exchange and or refunds are at the final discretion of Cori Anthony Clothing Co.

• Please direct any questions regarding the return of merchandise or to receive authorization on returns to returns@corianthony.com.
 

Return Authorization

1.  Any package that is not pre-approved for return will be refused
All orders must me authorized for return before they are sent through mail. Please do not send your order for return without authorization. If your order is sent to us through mail without proper authorization, we reserve the right to keep your order and your order will not be sent back under any circumstances.

2. To get authorization on a return, please contact us via e-mail, have your order number available which is located on the invoice sent with your item(s) and you will be sent back an authorization for your return.

All requests must be in writing and in accordance to the information below:

  • Name and Address where items were shipped
  • Name and Address of person paying for the order (if different)
  • Date ordered
  • Date received
  • Product you would like to return and quantity
  • Reason for return
  • Confirmation that packaging and tags are in tact and no packs have been opened, tampered with, used or damaged.
  • Problem with shipment - please be specific (If applicable)
  • A copy of or original invoice must accompany the sold merchandise.
  • All returns must be sent to the address specified when your authorization number is assigned.

    • 3.  The authorization number must be written on the outside of your box next to the shipping label and packed back in our original packaging - unless the box was damaged.


    Shipping

    We do not issue credits or refunds on shipping and handling charges and return shipping is at customers expense, unless we have made a mistake of sending you the wrong order/item or if you received a damaged item.  If you are returning an item that was free shipping upon ordering you will be charged the exact rate that we paid to have it shipped to you plus a $5.00 handling fee. - No Exceptions

    It is also your responsibility that the item is returned in the same condition sent to you.  Any damages done in return shipping are your responsibility and no refunds will be given.  All shipping charges are your responsibility and we suggest insurance and tracking numbers. Upon safe return and inspection of your product, an exchange or refund will be issued as soon as possible dependant upon your original form of payment.  Items must be returned unopened in their original packaging with original tags in tact.  If upon receipt we find that tags were removed, original package was tampered with or opened we will not refund nor send back to you unless return shipping charges are prepaid by you.   Absolutely no refund or exchange will be given for opened or damaged products - No Exceptions.
